Wales & West Utilities is asking the High Court to judicially review the Competition and Market’s Authority (CMA) decision on the company’s appeal against Ofgem’s Final Determination for the RIIO-GD2 Price Control.

Wales & West Utilities own and operate the gas network that keeps the gas flowing to 7.5 million people in communities across Wales and south west England.

We disagree with the standard of review and the legal interpretation of a number of statutory provisions made by the CMA on our appeal. There are certain items of which legal clarification is to be sought.

We do not take this step lightly. These statutory provisions have never been tested by a judicial review, and we hope this process will provide clarity for both energy companies and the regulator, Ofgem, on their responsibilities.
