Wales & West Utilities seeks to appeal against Ofgem’s final determination on its decision relating to Ongoing Efficiency setting for the RIIO-GD2 Price Control
Wales & West Utilities has today confirmed it will be seeking to appeal to the Competition and Markets Authority (CMA) against Ofgem’s Final Determination in relation to a discrete area of its settlement for the RIIO-GD3 Price Control period.
The company, which owns and operates the network that keeps the gas flowing across Wales and the south west England, submitted its 2026-2031 Business Plan in December 2024. Shaped by feedback from over 200 engagement events involving tens of thousands of customers and stakeholders, the ambitious yet attainable plan reflects the views of communities right across its large operating area. Customer priorities included keeping the gas flowing safely and reliably to homes and businesses, investing for a green future, and enhancing the support available to support the most vulnerable of customers
Following a number of weeks of detailed review, the company’s Board and executive management team have unanimously concluded that Ofgem’s RIIO-GD3 Final Determination which sets a 1% per annum “ongoing efficiency” target for the price control period is unsupported by evidence and fails to account for a broader slowdown in UK productivity since the Global Financial Crisis in 2009. Therefore, the company has commenced an appeal to the CMA.
